1. Acceptance of Terms
Welcome to Strive ("App," "Service," "we," "us," or "our"). By downloading, installing, or using the Strive application, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
Strive is a wellness tool designed to support individuals in substance abuse recovery through daily habit building, coping tools, and support networks. Strive is categorized as a Health & Fitness application.
Important: Strive is NOT a substitute for professional medical treatment, therapy, or emergency services. If you are in immediate danger, call 911 or your local emergency number.
2. Eligibility
To use Strive, you must:
- Be at least 13 years of age. Users under 13 are prohibited from using the App in compliance with the Children's Online Privacy Protection Act (COPPA).
- If you are between 13 and 17 years of age, you acknowledge that you have reviewed these Terms and affirm your eligibility to use the App.
- Provide accurate and complete information during registration.
3. Account Registration
To access certain features of the App, you must create an account. You agree to:
- Provide truthful, accurate, and current registration information.
- Maintain the security and confidentiality of your login credentials.
- Notify us immediately of any unauthorized use of your account.
- Accept responsibility for all activities that occur under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
4. Description of Service
Strive provides the following features to support recovery:
- Daily Check-ins: Self-assessment tools for tracking mood, cravings, and overall wellness.
- Coping Tools: Breathing exercises, a craving kit with quick-access techniques, and a customizable safety plan.
- Trigger Tracking: Tools to identify, log, and analyze personal triggers.
- Journaling: Private journal for personal reflection and emotional processing.
- Supporter System: Invite trusted individuals to receive wellness signals (never private details).
- Emergency Resources: Quick access to crisis hotlines and trusted contacts.
- Insights & Analytics: Personal trends and patterns based on your data.
- Resource Library: Educational articles about addiction, coping, and recovery.
5. User Conduct
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws.
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
- Interfere with or disrupt the operation of the App or its servers.
- Attempt to gain unauthorized access to any portion of the App or any other systems or networks.
- Use the App to harass, abuse, or harm another person.
- Send unsolicited or unauthorized messages through the supporter messaging system.
- Reverse engineer, decompile, or disassemble any part of the App.
6. Health & Wellness Disclaimer
Strive is a wellness support tool and does not provide medical advice, diagnosis, or treatment. The App is intended to complement, not replace, professional healthcare.
- The risk level indicators, insights, and analytics provided by the App are based on self-reported data and algorithmic calculations. They are not clinical assessments.
- Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition or treatment.
- Never disregard professional medical advice or delay seeking it because of information provided by the App.
- If you experience a medical emergency, call 911 or your local emergency number immediately.
7. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Key privacy principles:
- All recovery data is private by default.
- Journal entries are always private and are never shared with supporters or any third party.
- You control what wellness signals your supporters can see through granular permission settings.
- We do not sell or share your personal data with third parties for marketing purposes.
8. Supporter System
The supporter feature allows you to invite trusted individuals to receive limited wellness signals. By using this feature:
- You acknowledge that you are responsible for inviting only trusted individuals.
- Supporters may only view information you have explicitly permitted through your privacy settings.
- Messages sent through the supporter system must be supportive and encouraging in nature.
- You may remove a supporter at any time, which will immediately revoke their access to your data.
9. Emergency Resources
Strive provides access to crisis hotlines and emergency contact features for your convenience. These resources are provided as-is:
- Crisis hotline numbers (such as the 988 Suicide & Crisis Lifeline and SAMHSA National Helpline) are provided for reference and are operated by independent third parties.
- We are not responsible for the availability, accuracy, or quality of third-party emergency services.
- The one-time location sharing feature sends a single GPS snapshot via SMS. Strive does not continuously track your location.
10. Intellectual Property
All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, and software, are the property of Strive or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works of any content from the App without our prior written consent.
11. User-Generated Content
Content you create within the App (journal entries, check-in data, safety plans, etc.) remains your property. By using the App, you grant us a limited license to store and process your content solely for the purpose of providing the Service to you.
We do not access, review, or share your personal content except as required by law or as necessary to maintain the security of the Service.
12. Account Termination
You may delete your account at any time through the App's profile settings. Upon account deletion:
- All your personal data, including check-ins, journal entries, triggers, milestones, and messages, will be permanently deleted.
- Supporter links will be removed from both sides.
- Pending invitations will be marked as expired.
- This action is irreversible.
We reserve the right to suspend or terminate your account if you violate these Terms, with or without prior notice.
13. Limitation of Liability
To the fullest extent permitted by applicable law:
- Strive is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
- We do not warrant that the App will be uninterrupted, error-free, or secure.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the App.
- Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid to us (if any) in the twelve months preceding the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless Strive, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the App or your violation of these Terms.
15. Changes to Terms
We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page and notify you through the App. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
